By accessing our website or using any Reformiqs services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, clients, and users of Reformiqs services.

2. Description of Services

Reformiqs provides remote medical scribing and clinical documentation support services to licensed healthcare providers. Our services include post-encounter scribing, pre-charting support, and real-time live scribing. Services are provided subject to a separate service agreement executed between Reformiqs and the client.

3. Eligibility

Our services are intended for licensed healthcare professionals and authorised representatives of healthcare organisations. By using our services, you represent that you are a licensed healthcare provider or are authorised to act on behalf of one, and that you have the authority to enter into a binding agreement with Reformiqs.

4. Client Responsibilities

  • Provide accurate and complete information when submitting documentation requests
  • Review all completed notes before signing, approving, or incorporating them into the medical record
  • Maintain ultimate responsibility for the accuracy and completeness of all clinical documentation
  • Comply with all applicable laws, regulations, and professional standards governing clinical documentation
  • Ensure that your use of our services complies with your organisation's policies and applicable licensing requirements

5. HIPAA Compliance

Reformiqs operates as a Business Associate under HIPAA. We will execute a Business Associate Agreement (BAA) with each covered entity client prior to the handling of any Protected Health Information (PHI). Our HIPAA compliance obligations are detailed in our HIPAA Notice of Privacy Practices.

6. Accuracy and Review Obligation

Reformiqs strives for high accuracy in all documentation. However, the provider retains full professional and legal responsibility for all clinical documentation. All notes delivered by Reformiqs must be reviewed and approved by the licensed provider before being finalised in the medical record. Reformiqs does not provide medical advice, diagnosis, or treatment.

7. Confidentiality

Both parties agree to maintain the confidentiality of all information shared in connection with the services. Reformiqs will not disclose client information or patient information to any third party except as required by law or as necessary to provide the services, subject to appropriate confidentiality obligations.

8. Intellectual Property

All content on this website, including text, graphics, logos, and design, is the property of Reformiqs and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. Clinical notes produced for a client are the property of the client upon delivery and payment.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Reformiqs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim arising from our services shall not exceed the fees paid by you to Reformiqs in the three months preceding the claim. Nothing in these terms limits liability for fraud, gross negligence, or wilful misconduct.

10. Indemnification

You agree to indemnify and hold harmless Reformiqs, its employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these terms, or your violation of any applicable law or third-party rights.

11. Termination

Either party may terminate the service relationship in accordance with the terms of the applicable service agreement. Reformiqs reserves the right to suspend or terminate access to its website or services for any user who violates these terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in the United States.

13. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms.
